In my taxonomy speech crimes are any crime that requires proof of an element of communication to secure a conviction. The First Amendment is powerful and precious to all Americans but it's not held to protect all forms of communication from criminal prosecution. A few of the following charges are examples of speech crimes that I have defended in court:
- False Report of a Crime
- Threatening a Violent Act/Terroristic Threats
- Propositioning a Minor
A criminal charge involving an element requiring communication always requires an examination of the alleged conduct with an eye to ensuring that any properly available defense predicated on the First Amendment is employed to the best effect.
